Swallow's ship takes him to Nova Scotia. From there, he goes to England. He applies to the Rhode Island government for compensation of his losses but the government denies his request. He moves to North Carolina after receiving an appointment as North Carolina's Chief Justice, where he delivers an important court decision arguing against slavery. In 1777, he is forced to flee to England again because of his Loyalist sympathies.
